I am planning a DR solution that includes SQL mirroring and BES 5.0 High Availability. I know that the HA servers use the same SRP and whatnot, so do I need to have two legal copies of the BES software or does one suffice as long as they aren't both up at the same time?

you only need one copy, the other BES does not do anything until failover but it is online waiting.
